By downloading, installing, accessing, or using the Service, you acknowledge that you have read, understood, and agree to be bound by these Terms. 2.1. Account Creation: To access certain features of the Service, such as saving custom reaction sticker packs and preserving your AI style settings, you may be required to register an account. You agree to provide accurate, current, and complete registration information.

2.2. Credentials Security: You are solely responsible for maintaining the confidentiality of your account credentials, including usernames and passwords, and for all activities that occur under your account. You must notify us immediately at lifeline2023@outlook.com of any unauthorized access, use, or breach of security.

2.3. Account Termination: We reserve the right, in our sole discretion, to suspend, restrict, or terminate your account without notice or liability if we detect any suspicious activity, fraud, registration under false identities, or violation of these Terms.

Chapter 3: Eligibility & Child Safety Protections (COPPA/GDPR Compliance)

3.1. Strict Age Limitation: Protecting children's safety online is our highest priority. The Service is strictly not intended for, and may not be used by, individuals under the age of 13 (or under the age of 16 in the European Economic Area or European Union). Chapter 4: AI Face Image Uploading License & Legal Responsibilities

Our Service utilizes advanced artificial intelligence models to transform portrait photos into stylized stickers. When you upload a selfie or portrait photo, you agree to the following rules:

4.1. Photo Ownership: You retain full ownership, copyright, and image rights to all original portrait photos you upload to the Service.

4.2. Temporary License Grant: By uploading photos, you grant EmojiMe a temporary, non-exclusive, royalty-free, worldwide license to process, crop, and run the image through our AI models solely for the purpose of generating your stickers. This license expires immediately upon completion of the generation, and we do not use your photos to train our public models.

4.3. Full Indemnification: You agree to defend, indemnify, and hold harmless EmojiMe, its developers, and affiliates from and against any claims, damages, liabilities, losses, costs, or expenses (including reasonable attorneys' fees) arising out of or related to your unauthorized upload of third-party images.

Chapter 5: AI-Generated Content Intellectual Property Rights & Commercial Use Limits

5.1. Output Ownership: You own the final generated reaction memes and stickers created by the Service. You are free to share, download, and distribute them for personal, non-commercial social communication purposes.

5.2. Commercial Restrictions: You may not sell, lease, license, or commercially exploit any generated outputs that contain the likeness of other individuals without their explicit, written authorization. Commercial redistribution of the app's style assets is strictly prohibited.

5.3. Abuse Prevention: You agree not to use the generated outputs to harass, defame, bully, or mock others in a malicious manner. The platform reserves the right to terminate accounts that generate harmful content.

Chapter 6: Prohibited Uses & Deepfake/Impersonation Ban

You agree to use the Service in compliance with all applicable laws. You are strictly prohibited from:

• 6.1. Impersonation & Deepfakes: Using the Service to spoof, mock, or fake the identity of public figures, politicians, or other private individuals with malicious intent, or generating misleading content designed to deceive others (Deepfakes).
• 6.2. Harmful Content: Generating, sharing, or storing reaction memes that are unlawful, abusive, harassing, defamatory, hateful, racially offensive, sexually explicit, or encourage violence.
• 6.3. Reverse Engineering: Attempting to reverse engineer, scrape, disassemble, decompile, or extract our proprietary AI models, source code, or application database.
• 6.4. Automated Access: Using automated bots, scripts, or scrapers to access the Service or bypass our security and usage limits.

Chapter 7: DMCA Copyright & Image Rights Infringement Policy

We respect the intellectual property of others. Under the Digital Millennium Copyright Act (DMCA), if you believe that any content generated or hosted on our Service infringes your copyright or publicity rights, you may submit a takedown notice to our designated agent at lifeline2023@outlook.com.

Your notice must include the following details:

• 1. A physical or electronic signature of the owner or authorized representative.
• 2. Identification of the copyrighted work or image claimed to have been infringed.
• 3. Specific identification and URL of the infringing material on our Service.
• 4. Your contact details (address, phone number, email).
• 5. A statement made under penalty of perjury that you have a good-faith belief that the use is unauthorized and that the information in your notice is accurate.

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. TO THE MAXIMUM EXTENT PERMITTED BY LAW, EMOJIME EXPRESSLY DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

8.1. AI Limitations: You acknowledge that AI image generation involves unpredictable algorithmic randomness, caricature exaggeration, and artistic distortion. We do not guarantee that outputs will match your expectations or be aesthetically pleasing. We disclaim all liability for generated images perceived as unflattering or satirical.

8.2. System Stability: We do not guarantee that the Service will be uninterrupted, secure, or free from bugs, server errors, or data transmission delays.

Chapter 9: Limitation of Liability

9.1. General Limitation: TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL EMOJIME, ITS AFFILIATES, OR DEVELOPERS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, USE, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICE.

9.2. Liability Cap: OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED 100 USD OR THE TOTAL AMOUNT YOU PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, WHICHEVER IS LOWER.

Chapter 10: Governing Law, Dispute Resolution & Class Action Waiver

10.1. Governing Law: These Terms and any dispute arising from your use of the Service shall be governed by and construed in accordance with the laws of the jurisdiction of our incorporation, without regard to conflict of law principles.

10.2. Arbitration & Venue: Any dispute arising from these Terms shall first be resolved through good-faith negotiation. If unresolved, it shall be submitted to the competent courts of our registered jurisdiction.

10.3. Class Action Waiver: YOU AGREE THAT ANY DISPUTE RESOLUTION PROCEEDINGS WILL BE CONDUCTED SOLELY ON AN INDIVIDUAL BASIS AND NOT IN A CLASS, CONSOLIDATED, OR REPRESENTATIVE ACTION. YOU EXPLICITLY WAIVE YOUR RIGHT TO PARTICIPATE IN A CLASS ACTION LAWSUIT against us.

10.4. Severability: If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.

第五章：AI 生成物知识产权归属与商业使用限制

5.1. 生成物所有权归属： 您拥有本服务为您生成的最终搞怪表情包、贴纸的完整权利。您可以自由地在社交媒体、聊天工具中分享、下载和作为个人非商业社交使用。

5.2. 商业使用限制： 未经肖像所有人的明示授权，您不得将包含他人肖像的生成物用于任何商业推广、广告或商业牟利目的。严禁反向收集、包装本服务的艺术生成资产进行商业转售。

5.3. 滥用行为限制： 您同意不将生成的表情包用于任何恶意丑化、人身攻击、霸凌、侮辱或损害他人人格尊严的传播行为。本平台对此类行为保留封禁账户与追究法律责任的权利。

• 6.3. 反向工程： 对本服务的 AI 推理系统、底层算法模型、接口、网页源码进行反向工程、逆向编译、抓取、提取或进行 DDoS 攻击。
• 6.4. 恶意自动访问： 使用自动脚本、机器人或爬虫程序绕过本平台的安全防护机制或非正常获取本服务资源。

第七章：DMCA 版权与肖像权下架申诉程序
